Former FBI Employee Claims Wrongful Firing Over LGBTQ+ Flag Exhibition

A long-serving Federal Bureau of Investigation operative has initiated legal action claiming his dismissed because of having a Pride flag in his workstation.

According to David Maltinsky, who worked with the bureau over a decade and a half, the termination recently is being described as “improper and biased”.

Legal Action Alleges First Amendment Breaches

The legal filing argues that the agency violated the plaintiff’s free speech protections and took punitive action toward him because of engaging in protected speech.

The former specialist is seeking a legal ruling to restore his job at the bureau.

Information of the Legal Filing

The comprehensive filing, filed in federal court in Washington, D.C., claims that the employee was dismissed from his training last month over previously displaying the banner at his workstation.

As stated in the filing, the rainbow symbol was awarded to the employee to acknowledge his work to support the agency’s equality efforts.

Since childhood, my goal has been to serve the United States and ensure its security beside the skilled and devoted individuals in the bureau,” stated the plaintiff.

He continued, I showed that banner – which in 2021 was displayed at the Wilshire federal building – not for political reasons, but as a symbol of acceptance, solidarity and impartial service.

These ideals that once made the FBI strong. Currently it stands as where employees like me face discrimination. I think I was terminated not because of who I am, but due to my being: a proud gay man,” he concluded.

Sudden Dismissal Before Graduation

Earlier this year, the plaintiff gained admission to the federal agent training academy at the FBI facility, until what he called “sudden termination shortly before graduation”.

The filing additionally states that at some point after the presidential inauguration, another employee reported an issue to the overseeing official regarding the exhibition of the LGBTQ+ symbol.

“Out of an abundance of caution, the employee requested that the Chief Division Counsel for the local bureau examine whether or not the exhibition of the LGBTQ+ banner was allowed,” the complaint noted.

It further mentioned, The legal officer informed Maltinsky that showing of the symbol complied with the agency’s standards.”

Informing of Firing

However, in early October, Maltinsky received notice of his firing.

In correspondence referenced in the filing, bureau chief Kash Patel stated, “I have determined that you exercised poor judgment with an inappropriate display of a political symbol in your work area during your previous assignment at the L.A. bureau.

Under Article II of the United States Constitution, and regulations of the U.S., your position with the FBI is concluded.”

Lawyer Comment

In a release released this week, Maltinsky’s lawyer the attorney said, “This administration’s illegal termination is part of an extensive initiative to purge government departments of workers with different viewpoints, or belong to marginalized groups, or individuals that oppose bias.

This battle is not only for him, but also about ensuring the rights and freedoms of every government worker.”

Bureau Response

The agency declined to comment regarding the case.

Comparable Legal Cases

This legal action comes after another one filed in September by previous senior FBI officials that claimed they were unlawfully fired.

They stated that the director claimed he was instructed by the White House to fire any employee associated with a probe concerning Donald Trump.

Meanwhile, the FBI fired an experienced official recently subsequent to the director reportedly became furious due to accounts that the agency head used an official aircraft to be present at a wrestling event during which his partner performed the Star-Spangled Banner.

Steven Palmer, a bureau veteran for many years, was removed from leading the FBI’s critical incident response group, responsible for serious incidents and the agency’s jet fleet.
